伴侶盟針對我國政府兩公約國家人權報告提出中英文版的「同性與異性非婚伴侶、多元家庭及性別平等教育議題」影子報告,供明年來臺的國際人權專家(審查委員)參考。

摘要:

伴侶盟所提影子報告回應中華民國(台灣)政府2012年4月20日發表之《公民與政治權利國際公約初次國家報告》第289、290點相關非婚伴侶、多元家庭之議題,以及《經濟與社會文化權利國際公約初次國家報告》第23點第2段有關性別平等教育的議題。我們認為國家報告雖然承認法律對非婚伴侶、多元家庭保障不足,但卻避而不談現行法律對於非婚伴侶與多元家庭的排除,其實根本上肇因於歧視,按照前述第289點的行文脈絡,國家報告竟只談同性伴侶(及非婚異性伴侶)單點的權利或福利,刻意忽略「身分關係」合法化,好似「各項權利與福利」與「身分關係的承認」在台灣法制中可以被切分開來(實則具有密切關聯性)。
我們建議除了應儘速訂立相關法律保障非婚伴侶與多元家庭的身分關係與相關權利、福利外,也應落實各級學校的同志教育及反歧視教育。

Shadow Report on Homosexual and Heterosexual  Non-Marital Partnerships, Diverse Families, and Gender Equality Education in TAIWAN

abstract:

“This report serves as a response to Points 289 and 290 of the Republic of China (Taiwan) government’s Initial State Report on the International Covenant on Civil and Political Rights (ICCPR) published on 20 April 2012, which discusses non-marital partnerships, alternative family types and other related issues. This report also serves as a response to Point 23, paragraph 2 of Taiwan’s Initial State Report on the International Covenant on Economic, Social and Cultural Rights (ICESCR) regarding gender equality education and related issues.While we recognize that the report concedes that protection for the aforementioned groups is inadequate, it avoids discussing the fact that these groups lack protection under the current legal regime, as well as the social discrimination that underlies these issues. Furthermore, Point 289 of the report focuses on some specific rights and benefits of gay partnerships and
non-marital heterosexual partnerships, specifically neglecting the legalization of the “relationship status,” effectively separating the “individual rights and benefits” from the “recognition of relationship status,” where they are in fact intimately related.
Accordingly, in addition to proposing the swift enactment laws to protect the status, rights and benefits of non-marital partnerships and diverse families, we strongly recommend implementing anti-discriminatory education programs (including LGBT education) throughout all levels of Taiwan’s education system. ”
